Mediation Preparation:
Generally speaking, all parties necessary to the decision making process, with full
authority to settle the case, should be physically present or available by phone.
Communications made during the mediation process are confidential.
If possible, at least two days prior to the mediation session, I would like to see faxed briefs
from all parties containing the facts, the law, a brief description to all damages
claimed/disputed, a list of all discovery completed/pending, a list of all motions
heard/pending, and the status of settlement negotiations to date. My fax number is 559-561-4273.
The Plaintiff(s)' brief should also include a demand, and an itemization of any special damages.
Briefs may be marked "confidential" or they may be exchanged between the parties.
